Gill instructs Morrow to obtain that report. Forum Expert Services prepare the report. It is based on medical evidence and relies on a life expectancy of 49.3 years for Gill. The estimated loss, including loss of income for Gill as set out in the report is $1.983 million. On Gill’s instructions, the expert’s report is given by Morrow to the lawyer for the employer and to the lawyer for the insurer.
The parties agree to mediation in early January 2020 with an independent and qualified mediator. Morrow briefs a barrister to represent Gill at the mediation.
Four days before the mediation is due to take place Gill meets with Morrow at her office. Gill says to Morrow, “I really want to get as much money quickly. I want to travel and give up work. My GP diagnosed that I have a breast cancer and it is at a very advanced stage… Maybe I will live another 3 or maybe 4 years,” Only Morrow, and Gill are present at that meeting.
